They didn't have a weapon , stabbing someone six times isn't self defence.

He could have just let them take his cannabis. Article doesn't explicitly say he is a drug dealer, but possibly seems it is implied if the stash was worth breaking in to his house with threats.

If he had drew the knife in response to "right we are gonna batter you senseless/kill you because we can't have you talking about this theft" he probably would have got off.

Why hide the knife in a bin when claiming self-defence?

There were 2 of them and while they might not have bought a weapon, there were no doubt household 'weapons' available to them (as shown by the homeowner!!).

Personally I believe a person has the right to defend themselves and their property if they are at home and multiple attackers break in with force. It would seem to create a reasonable possibility that violence could follow and the homeowner would then be outnumbered.

Obviously the law disagrees with me in this case but it does seem a bit harsh that he gets years in prison while the surviving burglar/robber gets to walk away with a suspended sentence and community service. After all it was the robbery that set those events in motion.

So I went out and bought a Garden Alarm.

For those that don't know what this is. It is similar to a motion detector you have in your home with a burglar alarm. Only difference being it is weatherproof motion detector and you can discretely hide it outside. When triggered it sets of a Chime noise on a receiver box.


Next time he came back at 2 in the morning to try the Door, he triggered it i chased him off with a Baseball Bat.

If you have a nice Car like i have you can position one near the Car obviously away from direct sunlight. And only triggered by a prowler.

Prevention is better than the cure.

The legal eagles will advise better but, you are by law meant to retreat rather than fight. But common law states that once you have reached your house you can defend it, i.e fight.

Well he plead guilty to it. And as he had told porky pies about being threatened with a knife and not drawing it himself, that probably explains why.

Hopefully he is well treated and receives appropriate support in the community when he is released.

None of this is true. These are mitigating factors taken in to account when applying the tests of self-defence.

There is no expectation that you have to wait for an attack before responding.

Suppose he was carrying a hammer or a heavy tool bag as he approached in the garden, it wouldn't be unreasonable to preempt the attack and chase him in the garden.

You can't use violence as revenge or to recover property but you can follow someone to arrest them, providing it is an indictable offence (it is).

If he had caught him and battered him it would have been a different story though.
 
Again, if people left other people's property (homes, cars etc) alone there wouldn't be an issue, legal or otherwise. The laws should be stricter, I'd have no issues with offenders having hands chopped off for breaking into people's houses and stealing things, they should get a fucking job and buy stuff like the rest of us have to, a Friend of the Family is a Magistrate who was always a do-gooder about how you shouldn't protect your possessions and should allow them to take them without fighting back, a few years ago he was burgled in the night, his opinion has now changed to the point where he would sooner go to Prison.

I think that's a good result all round personally.
