Would it be different if city had given their contractually obligated seats to Viagogo before they had announced that the game was sold out for people wanting to buy direct from the club?

I think it is the case that city give these seats to viagogo before the game is sold out - it's likely that viagogo simply wait for the game to sell out before making them available (increased demand = higher prices)

d. the Purchaser must notify the Club in writing of the personal contact details (including the Address) of the person to whom the Membership Scheme is being transferred; and
e. such transfer must not breach clause 2.1 above.
The person to whom the Membership Scheme is transferred under this condition shall adhere to and be bound by these Membership T&Cs and the Conditions of Entry and it is the responsibility of the Purchaser to inform such a transferee Member of these requirements.
5.2. Membership Schemes and Membership Benefits (including, without limitation, Membership Cards) are for the use of the Member only and are not transferable save that, if a Member is unable to attend a Match that Member may temporarily allow a person who is known to them (a “Guest”) to use their Membership Card for the purpose of allowing that Guest to attend such Match provided that:
a. such transfer must not be made in the course of business or for the purpose of facilitating any third party’s business;
b. the transfer must be free of charge; and
c. such transfer must not breach condition 2.1 above.
The Guest shall adhere to the Conditions of Entry which shall bind the Guest as if they were the original Member and/or Purchaser of that ticket. It is the responsibility of the Member who owns the Membership Card to inform the Guest that they shall be subject to Conditions of Entry.
5.3. Subject to conditions 5.1 and 5.2 above, all rights with respect to a Membership Scheme are personal to the Member and shall cease upon the death of the Member. Any Membership Benefits accrued including (without limitation) any Loyalty Points are not transferrable to any other person or organisation. The Club may, at its absolute discretion, offer a refund in respect of any Matches unattended at the time of the Member’s death, to the Member’s estate / personal representative.

5.1 I think refers to the whole membership, but is a bit ambigous.

it's not an entire block. its a couple of rows at the back of the stadium. for the majority of last season there were a few rows of foreign fans particularly at the big games. The foreign fans will always snap these tickets up regardless of the price.
 
now let me get this right, city have a full section on sale for spurs on the exchange, now as long as you get a blue members card you can get tickets, so in a couple of months time, we play utd, now what could happen at this game, a few hundred utd fans sat with city fans, it aint going to look nice is it.

So there is absolutely nothing in City's terms to prevent what TicketX were doing. The reasoning the club gave in the MEN article is that there are no safeguards in place to prevent touts or away fans getting hold of tickets. In fact, it's pretty easy to tell who is a genuine blue on places like Twitter, the accounts give it away: the twitter account was itself a safeguard, because it was run by blues, for blues. In terms of the safety aspect, having it all go through a central hub as such would be safer than have it every man for themselves on twitter. Much easier to see who is reliable and genuine, and who is not.

As someone has already stated, the club's agreement with viagogo means that in all probability they have to make a small number of tickets available to them to sell on, regardless of whether it's a sold out game or not. We're not the only club that uses a ticket agency to sell tickets on. What appears to have got so many people's backs up is that these tickets appeared on viagogo after the club announced that the match was a sell out and I can understand the frustration with that.

However, I think what is more unpalatable is the mcfcticketX Twitter account being pulled as I don't see how that is any different to City fans offering their tickets to other fans on this or any other forum.
 
Will be meeting with the club, hopefully in the very near future so they can give their side.

Will keep all updated but the corporate whoring of our club, a club 'for the fans' is hard to take.

@MCFCTicketX is making a return. It will change to a different username but all will be the same.
