As I said before the prosecution tried to drop the charges yesterday, but the judge said he will stand trial, if the prosecution cant be arsed then there isnt much chance of a conviction.

They'll lose a lot of face if that happens, Messi won't stand back and let his dad take the rap, it'll be very, very obvious why he got off. They've fucked up here, should have accepted the restitution offer.

The Spanish State Legal Service has called forLeo Messito serve a 22-month prison sentence for tax offences committed between 2007 and 2009.
According to reports by El País, the State Legal Service acknowledges in its statement that Messi is "no expert" in tax matters, but claims that he "could not be unaware" that a significant portion of his income from the use of his image rights came from companies in tax havens such as Uruguay and Belize.
In contrast with public prosecutors, the State Legal Service - which represents the interests of the Tax Agency - is of the opinion that both the Barcelona striker and his father, Jorge Horacio Messi, should stand trial.
The investigating judge in Gavà (Barcelona) has issued an order to proceed to trial which will place both father and son in the dock.
Messi, whose trial will be overseen by a criminal judge from Vilanova i la Geltrú (also in the province of Barcelona), will sit in the dock alongside his father, in spite of the request by prosecutors that the charges against the footballer be dropped because he was oblivious to the fraudulent actions committed by his father.

Messi being tried in Barcelona has about as much chance of being convicted as Ken Dodd when he was up in court on Liverpool.
