After collecting my thoughts on this somewhat, I think that there is one stark lesson that has out of this:

If you don't care whether you live or die, you can morally and financially bankrupt the U.S. and its citizens with only the smallest amount of effort.

I disagree, fundamentally with your point.

I would go so far to say that having him on trial where hard line clerics can point to him being 'abused' and 'tortured' and perhaps 'enslaved like a dog' would create more terrorists than you could ever believe.

We should stick to our principles even in the darkest hour. If they find giving him a fair trial contemptible; so be it.

Now that Stalin's been mentioned, there is an analogy to an incident which occurred after the Second World War. Once the Nazi leaders and generals had all been captured, Stalin proposed that they should all be summarily executed. Churchill, in disgust, remarked that he would rather be 'taken outside and shot' than abandon the values established at the cost of countless Allied lives. That, to me, is admirable.
