Parking Eye

When I got done by Parking Eye for going over the time by 14 minutes we had two cars with us and only one of us got the letter (who do you reckon!). For me it took them 5 days to get the letter out, I'd say you are fine after then and I don't think they can go for you legally after 14 days anyway. I think they must get that many that they can't physically process enough of them in time..

I appealed mine on the basis that if they could provide me evidence of the loss which justifes their charge in a free empty car park at 10 at night then I would happily reimburse but otherwise I would be going to appeal through POPLA (costs them £30 just to hear it). Recieved it on the 15th of November and still awaiting to hear off my appeal to them, I am even thinking of charging them for replying late.

In my mind they make their money off the people who either pay up or ignore it, it costs them money however to fight people.

Although the law has changed, and given more power to the parking companies, the penalties (not 'fines' - only a court can impose a fine) are still based on contract law. A penalty in a private contract can only be imposed if they suffered an actual loss, which in this case only relates to the admin costs of issuing the ticket.

This was always my understanding of contract law, they can only claim in cases where there is actual loss and then only for the value of the loss.

Therefore why do they not have to prove loss i.e. the car parked over time actually stopped another customer from parking ?
Also if parking is free, what have the parking company lost?

Asda could claim loss but not Parking Eye.

If this was a commercial car park, proof of lose would be easier but surely limited to the value of another customers parking fees?
 
Apologies. This topic has been covered before but I seem to recall a change in the procedure recently in that it's best not to ignore these letters anymore.

Anyway, I've got a fine from Parking Eye saying I was in asda car park for 9 hours. Thing is the missus went in shopping at 9am and I went to put petrol in at 6pm. So it was two separate occasions.

I've got proof of my purchase using my card and I was in work that day so impossible for me to be there in the morning. The missus went in to buy a birthday cake for my daughter but they didn't have it so she left without purchasing.

If I go into asda will they sort it or do I have to go through parking fucking twating eye.
Simply ask them to provide evidence you were there for the period they state. It is for them to prove your guilt, not for you to prove your innocence.
No evidence. No penalty.
I had one years ago on a meter when I returned to the meter 2 hours after previously being there. (You have to be away for 90 mins after a 2 hour visit).
Returned to a ticket and had 3 or 4 letters back and forth disputing it and then they made the error of stating the times my car had been seen on the bay and the time was just over 2 hours from first being spotted to the second when the ticket was issued.
I repeatedly asked the question ''was it possible for me to leave and legally return within the times between the attendant had seen the car.''
They replied (I kid you not) that the attendant also checks the position of the air valve in the front tyre and it was the same. I replied that was a load of rubbish and finally they dropped it when I said I didn't want any further correspondence from them as I wanted my day in court.

Just got a fine I'm a numpty and put the wrong registration in of the car, we have two and yep i put the other one in, luckily I still have ticket and both cars are registered in my name I'm hoping I win the appeal.
Lots of examples on Internet of people who have done the same thing and have won their appeal. They would not take this all the way to court for a genuine error, as they would lose !
 
I have done quite a few successful appeals. 100% of the time when the fine/penalty was wrong I have managed to get the penalty charge dropped. On a few occasions where it was perhaps more debatable due to staying over time limits by 10 minutes etc. the case can usually be dropped due to technicalities.
There are a lot of online resources for this but if in the case of ASDA and Parking Eye I would always ask for sight of the contract that entitles Parking Eye to charge on land on which the car park is located. In approx. 10 cases I have done they have never been able to provide the contract and the case has been dismissed by POPLA.

PLEASE NOTE: I do this for fun on behalf of friends and relatives, I do not simply ignore parking regulations! The fact is that most of these parking charges/penalties are the basis for how these companies make money and in my opinion, it is a disgrace that businesses are allowed to operate legally on this basis in a modern democratic nation!

If anyone wants a bit of advice then PM me and I will do my best.

could a person ask to see the contract at say customer service desk on entering the store....If one wanted to be a **** or fore armed...or have i got the wrong end of the stick?
