The FA need to stop this retrospective action possibility, unless they are prepared to review every decision in every game in case the ref missed something, except if it's an exceptional incident ala Thatcher. Mariner clearly was watching play at the time along with the other three officials and didn't see anything that required action at the timr and that is where it should stop. Clearly Kun has been tried by media, agenda or not.
That's exactly why we should be appealing. Not to get Aguero off (he's got no chance) but to make it clear that we don't believe for a second that the referee didn't see this incident in its entirety at the time. They're not allowed to re-referee games so I'd want to know on record why the decision to charge him came about.
 
Personally think we just need to let it go. They need to look at it again, and rightfully ban him. The referee should be reprimanded also due to the clear ineptitude, of which I am thankful of; a straight red every day of the week. Very dangerous thing to do.

When was the last time a Man Utd player was banned through retrospective action especially for a foul that didn't connect. And which the ref clearly saw.

Even if there is pressure to ban him, I don't think it's a foregone conclusion Aguero will be banned because the defender is coming through the back of Aguero and fouling him as well. You can make a case for violent conduct. However if we're going to do that then that would mean that we'd have retrospective suspensions every weekend.

We wouldn't mate, we wouldn't have retrospective action every weekend. The only question with this one is why the referee didn't see it, he clearly did see it, but didn't act on it; that's poor officiating.
