At least you reply with some sense,my only caveat is the blokes mental state,I am not saying what I proposed is a 100% certainty but that it should be looked at further,the strange thing to me is how many people, service and ex service deny any such occurence,perhaps it's not so strange,anyone who admits to such frailty is usually told to man up and grow a pair.

Why did the Sgt not plead his case based on a reduced mental capacity? Could it be because he was fully aware of his actions perhaps

I am glad the Taliban guy got slotted but it is not the way our troops should be seen to be operating, it lowers us to the level of the insurgent... especially when caught on camera
 
I'm not a lawyer but I think he's going to struggle to get the case re-opened based soley on his mental state at the time of the shooting. If he was compis mentis at the time of the trial he could have introduced that evidence then. The fact that he didn't is his own fault (the defences fault). I think too that there probably has to be compelling new evidence that was not available at the time of the original trial or evidence of wrong doing by the prosecution in order to get an appeal.
What he needs to show is that he was not fit to stand trial because of his mental state at the time of the trial and go for a mis-trial.

I know his commanding officer Colonel Oliver Lee, who was an exceptional soldier, former commander of the special forces in Afghanistan, one of the youngest ever to reach the rank of Colonel in the history of the marines. He resigned his commission in protest over how Sgt Blackman was treated and the MOD refused to allow him to speak at Blackman's trial and then attempted to cover up the fact.

Hopefully when all the facts are known in court, he will at the very least have his sentence reduced, if not totally quashed.

I'm an ex serviceman myself and this is obviously a topic close to my heart and one that could have affected any number of personnel.A special mention for his wife who has acted with dignity throughout,i'm not sure many would have been able to hold it together like she has.
 
A mate has just posted this - As an ex serviceman having served for 35 years I reserve the right to speak my mind on what I believe to be a totally disgusting decision on the part of Sergeant Blackman. A serviceman is sent to do nasty things to nasty people in defence of his country and on the orders of its government and in return should expect its support. Bad things happen in war but you cannot pick and choose who to jail when the shit hits the fan. There are to many do gooders who would see this man put to the sword but would gladly welcome his protection when the boogie men come calling. Grow some balls judges and let him free now he will not do a runner and is prepared to appear for his appeal. While on the subject, how about turning your attention to the scum who threaten us daily and do something about them rather than turn on your own. Just sayin....
