Yes - she pays tax on her U.K. earnings, I agree that isn’t the issue discussed. Part of the point I was making is that she does not have to sever ties to India by not being a non-dom, which is what you were suggesting she would have to do. Domicile is nothing to do with nationality.
One of the reasons this story has legs is because it’s highly likely she is using tax havens to shelter her ‘international’ income. (The story would be killed dead if she declared the income to India). Not illegal, but lacking in scruples given she is the wife of the chancellor who enjoys the financial benefits she brings to the family.

You have to apply - its a conscious effort to gain the status. You do that if you want to "manage" your tax affairs so you only pay what you have to at the lowest rate possible.
