I think this is not what the resident legal experts said. I understood CAS would judge the case completely anew. @projectriver ?
Are you of the opinion that UEFA have additional information other than the leaks given their lawyers have obviously advised them to pursue this in court?CAS will go through the whole matter de novo (afresh) based on both sides' submissions and the evidence presented. They will consider the application of the rules including limitations, the relevant rules and, if it finds UEFA were entitled to review matters from 2012-2016 (City say UEFA were not for a number of reasons), it will consider the substantive matters ie whether City did, in fact, breach the rules. I agree we will probably not get a full view of the judgment until some weeks after the summary of the decision.
Suspect its the leaks plus the information already in their possession from before 2016/17. They banned us for 2 years plus the fine, there was no way once we took it to CAS that UEFA would back down and say 'You know what? Forget about it.' I don’t think that’s correct is it? They aren’t just looking at the process, they are looking at the facts, and giving their view on whether we actually breached the rules. If we are not guilty of anything, but uefa have followed the correct process, then we are still not guiltyCAS are not there to determine our supposed quilt they will judge on the process

Okay folks, let's stick to the subject of the thread and avoid bringing up old, controversial cases from America. They have nothing to do with our case.
I can’t see how info already in their possession from years ago can add weight to their case. That is what led to the settlement agreement in 2014 and they can’t just decide to use that to further punish us can they? Surely it has to be fresh info they weren’t aware of at the time, ie: the e-mails in the DS articles, plus there could be something else that we’re not aware of.
