Petrusha, if you don’t mind, what is your assessment of this case in general?
I made the point before of how can this of got to this point, our accounts are audited and clearly show (to my knowledge) the cash flow direct from Etihad & others, with that said how can hacked emails lead to this? On a legal stand point surely they are irrelevant.
How UEFA prove otherwise before CAS is next to impossible in my opinion, not to mention the dates past since the settlement that covered these original issues as well as being released from said settlement in 2017.
I know the question wasn't for me, so will allow Petrusha to answer as they see fit.
On the hacked emails, CAS would allow information to come from those sources to be used as evidence. UEFA clearly feel those hacked emails bring into question what was submitted to them from the club previously and having given us the chance (in their terms) to respond, didn't feel we could adequately explain away the emails and issued a decision subsequently banning us.
I've mentioned previously that I think City were always intending to take this to CAS as a fuck you to UEFA. We don't trust UEFA and why submit any additional information if they leak things to the media? Instead we can give CAS our evidence to justify why UEFA's decision was wrong. The matters of process in terms of the settlement having been in place, and fulfilled, and the time limit points could potentially be a reason in themselves for us to win the appeal but I'm not 100% on that side of things. Irrefutable evidence as we claim would not suggest City are fighting this purely on a procedural issue, but that we can quite clearly show we're not guilty and have chosen for the CAS appeal to be the stage where that information is presented to protect it from being leaked.
From day 1 on this, the club has been at war with UEFA. It was a big move by the club to get Ferran in front of a camera and rebut the claims. A simple statement would have been sufficient, but the club clearly wanted to go further and were confident even then, that we would defeat UEFA at appeal. All of that would come back to bite if we didn't have full confidence we could win this. I know people have stated that you're never 100% sure of success at appeal, but I think on this matter you probably could be close to that.
