My understanding is that evidence in the parliamentary expenses scandal was leaked to the Telegaraph and that it was only used in a very small number of cases to prosecute MPs for violations of the criminal law. Most of the leaks (not hackings) created enormous public outcry but did not result in their use in court. I don't know whether the admissibility of the leaked evidence was an issue but where it is used it is normally on grounds of an overriding public interest. The public interest defence was a defence which was accepted when information covered by the official secrets act was leaked to the press. As is often pointed out, though, overriding public interest is in no way to be confused with an enormous interest by the public. The right of the public to know of the abuse of public office for private gain clearly touches a vital public interest, but whether UEFA's wish to poke its nose into City's sponsorship deals touches any public interest at all is another matter entirely. This is not a matter which CAS can pronounce on but if UEFA persist this may become one of the central issues, along with UEFA's right to enact such regulations as FFP and enforce them by any sanctions. I think UEFA should think very carefully indeed before involving itself any further because we could indeed be in "a very different conversation", and one which could cost UEFA millions and lead certain high profile officials to prison, to say nothing of the consequences for the press.
 
So, as far as I see it and to summarise;

1. UEFA investigation team under the Belgian guy have found us guilty (of something) and passed on the file to UEFA recommending a 1 year ban from UEFA Comps.

2. UEFA (the one now with the file) need to decide on a punishment, could be a 1 year ban, but this process could take up to 10 months (wow!)

3. Khaldoon confirms no case to answer if based on facts.

4. The interesting bit, Khaldoon also says if not based on facts, then a different conversation?

Now what could that mean?
That we'll be found guilty but not based on facts.
 
I think it would be hilarious if it was Liverpool.

Can you imagine the mental gymnastics they'd have to do to explain why our success is all to do with dirty filthy human rights abusing arab oil money and theirs was actually all above board.

You're right. Let's look at this objectively. Liverpool last won the title in 1990 when....

Chelsea - winners of five Premier League Titles, were in their second season out of Division Two. Received investment from Abramovich

City - winners of four Premier League titles were in our first season out of Division Two. Subsequently dropped to third tier before having success. Received investment from Sheikh Mansoor.

Blackburn Rovers - One Premier league title, still in Division Two in 1990. Liverpool supporters danced in the aisles when Dalglish's Rovers team, who had received investment from Jack Walker, beat United on the last day of 1995 season.

Leicester City - One Premier league title - were in Division Two, and bounced between Prem and Championship in subsequent years. Received investment from Thai businessman (not going to attempt to mums-spell his name. RIP)

Leeds - were in Division Two, won the last First Division title played a role in the first 12 years or so of the Prem, before being Relegated. We know the rest of the tale.

United and Arsenal were already in the Top Flight as we know, and had won the lions share of Prem titles between them. Rags received investment from Edwards, then Glazers after Murdoch bid failed. Arsenal received Investment from Danny Fizsman (SP?) and Usmanov/Kroenke subsequently.

Newcastle (Hall & Ashley) Middlesborough (Gibson) Portsmouth, Villa, Brum West Ham have also received some investment but have not had success...like Liverpool, who had the Moore's, and then the first group of Americans who were almost ousted before Liverpool supporters appealed for Dubai investment, prior to FSG buying them 48 hours before entering administration.

Uefa do have the hacked material. Der Spiegel passed everything over apparently. Not that it matters. City haven’t argued the veracity or the material, but the context and prepared a 100 page rebuttal and evidence.
Do UEFA have all the data hacked or was just stuff relating to City passed on to them though?

I’d love to see us get our hands on everything, although what we could do with it is debatable. Who’d be interested in those leaks.
 
So It's possible that the AC can go against any conclusion the IC reached? Interesting because if City are indeed innocent and have provided irrefutable proof, then it gives them a chance to back out before it escalates further
That’s if they read our 100 page dossier of evidence of innocence.

They’re rooting through the IC’s green bin for it as we speak, I’m sure.
