City are taking the bad process judicial review route before the judiciary chamber even comes up with a verdict. The fact that UEFA clearly didnt even read our 100 page submission to the investigatory chamber - they clearly didn't respond to our submission - leaves UEFA wide open to abuse of process.

Ok so this CAS referral actually reinforces the idea that Juventus were waiting on the UEFA decision to get Pep. It also removes any possibility they will get him as UEFA can not now hand out a punishment until CAS has heard all the evidence. I'm assuming that the appeal is based on the fact that it was passed to the adjudicatory panel then another appeal, if that fails, is possible based on the severity of the punishment.
I don’t think it does to be honest. I don’t think it’s got anything to do with Pep.

No because I think we were a long way from any UEFA decision , doubt it would have been anytime this summer.
 
Of course the story has to be dropped by Rob Harris (him of the shit question in Pep's presser post Fa Cup final.
Much preferred him when he did the Old Grey Whistle Test.

But surely if we produce a defence to CAS, aren't CAS likely to say 'Defence against What?

I’m puzzled as well. I’m no expert but I thought CAS was only for arbitration when the parties agreed to that when the initial process of investigation & adjudication was complete.

It would have been this summer I think. They’d already decided the punishment before even finishing the ‘investigation’ and they wouldn’t want us in the CL next season with it out there that we were to be banned for the following season. What if we went on to win it after all.
 
I just don't get how this being even considered.
1. UEFA have broken the (presumably signed) confidentiality agreement a number of times.
2. Alleged evidence has been obtained illegally
3. The case was originally tried and sanctions given

Sorry - only a basic legal understanding but is it just that its not actually a court of law, but just a court of made up rules?

Absolutely zero chance of them allowing us to even get near the final if this is still hanging over us

It sounds like the issue is that we’ve presented substantial and possibly overwhelming evidence in support of our case and UEFA have either disregarded it or failed to properly examine it hence the ‘not followed due process’ remark. Instead they have foregone an adequate assessment of the evidence and rather gone straight to a judiciary panel for ‘punishment’.
