"The Premier League champions have asked the Court of Arbitration for Sport to throw out the case that has been passed by UEFA’s investigators to its judges, people with knowledge of the case told the AP. They spoke on condition of anonymity because the details of the ongoing investigation are confidential.

City is challenging UEFA’s right to send the Financial Fair Play case from the investigatory to adjudicatory chamber for a sanction to be imposed, the people said. The Abu Dhabi-owned club is claiming there is no case to answer, challenging the legitimacy and haste of the investigation.

City declined to comment when asked about taking the case to CAS but had previously said the referral to the judicial branch “ignores a comprehensive body of irrefutable evidence provided by Manchester City.”
 
So the club is trying to go straight to CAS rather than have to go through the PR disaster of being banned by UEFA'S kangaroo court and then appeal to CAS afterwards.

Should save a lot of time and a lot of reputation if true.

So let me get this right our owner can put in 200m for players but be tax on it and that money would go to the likes of milan madrid liverpool or the scum!? Wonder who thought that fcuker up.
As clubs like us get overcharged for said players. Shouldn't the selling club be taxed on their incomings/profit on the sold player and then distribute that?

If UEFA got the ban in first we would ordinarily appeal to CAS at that point. But am I right in thinking that once a case goes to CAS and we were to lose we give up on the right to then subsequently take UEFA to court?

If so, by being preemptive at this point and before any ban, we get the issues about the "process" over at this stage and still retain legal threat over any subsequent ban if we lose at CAS. Just a thought but I might be hopelessly wrong but hopefully means we get 2 bites of the cherry.
 
No. If true, we're going to the CAS before UEFA have even announced a punishment.
Should think UEFA have barely started looking at the stuff sent by the investigations. So would expect our case is against the process, the curtailment and the confidentiality of the investigators.
