It would potentially be (an expensive) way of kicking the can a long way down the road and suspending the ban for a long time. I think I'd rather take the ban and spend two years spending like a drunk sailor and winning everything domestically tbh.
I doubt they’d suspend the ban anyway, so we’d probably be back in European competition by the time the case was heard.

Soriano and khaldoon said explicitly that we have done nothing wrong,we will not take a ban otherwise they have ruined their credibility ,if we lose here we take it further
I get the feeling Kaz if we loose here then it wont be any better in Switzerland, I just have a gut feeling that we will win this case at CAS
 
The UEFA investigation and the media coverage seemed to me more like a witch hunt than a serious investigation of the Der Spiegel allegations. The British football media never once considered it from Manchester City's point of view yet they claim that journalism is there to question authority and privilege. They never did that once. They just capitulated to the agenda of clubs scrambling for a bigger slice of the pie partly because it suits the commercial agenda of their employers.

If we don’t win at CAS why are our chances improved at Swiss Courts. Plus we would still be out of champions league for 1 year minimum and lose out on current and potential new players. I don’t think we’d get before the Swiss courts that quickly. This is huge for us.
 
I thought who was funding the sponsorships was the whole point to the UEFA allegation based on the leaked emails naming the funding coming from 'HH'

That's my view as well but, put simply, Stefan's is that if Etihad & City have a contract that says Etihad will pay us an agreed sum and they pay us that agreed sum, then that's case closed.
 
Why would we take a 1-year ban when we turned down the offer of a fine?
Huge amount at stake, nothing is certain, commerciality. Of course, we haven't which suggests we are very confident (or less likely IMO, UEFA didn't want to deal). As for refusing to take a fine, that was close to negligent and a misjudgment in my mind. No good reason to gamble like this for the sake of a small payment (assuming it was).

We all obviously hope we win, I believe we will, but if CAS did go against us I don't think we would take it lying down. Fingers crossed it doesn't come to that.

So in stefan's opinion, what is the allegation that UEFA has made against us?

It would probably take years Ric and we’d still be out of the champions league. People who say we will challenge in the Swiss courts etc just don’t get it. If we don’t win at CAS the chances are we have to accept it and move on, but how for 1 year which I think is manageable.

Thats not really what I am saying. I am saying the funds flow into Etihad is their business. From a legal and accounting perspective if City show a) a contract with the obligations to pay from Etihad and b) the cash flows pursuant to an invoice from Etihad, it is for UEFA to prove that is a sham and to do that they somehow have to get behind the contract which they can't do. Whether Etihad is a related party is another question and one which UEFA previously concluded was moot because even if it was the contract was at fair value (all according to a suspiciously detailed article by David Conn). I dont know if ours chances would be good at the swiss court,our statement seemed to point towards we would go further than CAS though
if any players want to jump ship if we get a year then they welcome, "big" players went to the rags when they were in the europa league and in and out of the cl,i still th ink we will be able to get players in whilst giving phil and garcia a much biger role
This is huge and might hurt in the short term but it wont fatal unless pep,soriano and txiki jump ship ,then i would be more worried !
 
Spoke to someone pretty well connected at City earlier, and he said that the feeling within the club was that the hearing had gone really well. Could of course mean nothing, as the arbitrators have only just started their deliberations, but it sounds promising so thought it was worth sharing.
Very good news if the source is good. As I have said City will have a good feel for how receptive the panel was. No guarantees although I have had cases where my team said we had 100% lost by reading the reaction of the judge to what he had heard over a 6 day trial ie sometimes the lawyers are pretty sure which way its gone. Fingers crossed.
