I agree that he'll be charged - it's inescapable. However, charges probably won't be brought until after the midterms according to TV pundits I've watched.

However, the raid on Mar a Lago would definitely fall under that, as would releasing the court documents on Wednesday.

Trump isn't up for election in the mid-terms, nor has he announced he's running for President in 2024. He's currently a political non-entity.

He’s the defacto leader of the Republican Party, and by far the most certain 2024 candidate, pretending he’s a political non-entity is just childish.

Defacto leader or not he is still not announced his candidacy.

However, in 2016 there was a certain person who had announced her candidacy and was on course to win the election, yet the FBI very publicly opened an investigation in to a non-issue (in comparison to the current crime spree) which essentially derailed her campaign and swung the result in favour of Trump.

The risk to national security likely trumped (haha!) the memorandum.

Yes, that shouldn't have happened. Which is why Garland has upheld Barr's memo about not taking public action that could be seen as intefering with an election.

It would be political suicide to do it before the mid terms Imo.

The Dems look like they've managed to prevent the expected red wave but they aren't out of the woods yet.

If I recall the raid occured 91 days before the election to cover their ass?

Potentially, there's some debate as to when an election actually starts. Is it when voting opens (inc early voting, mail in etc.) or is it election day itself.

Also I've seen some commentators say that the FBI's public disclosures in the lawsuits (like those staged photos of all the top secret documents in Trump's office) would be seen as a breach of Barr/Garland's memo, but no one really knows definitively.

The other thing is the January 6th hearings start back up again this month, and those hearings are unofficially in partnership with the DOJ because they're passing everything over to them, so that makes a bit of a mockery of the spirit of the 90 day rule too.

All the Barr memo really does is reiterate that any investigation has to be sanctioned at the highest level of the DOJ, and that each case is taken on its merits.

IF the AG feels that potential law breaking by any individual engaged in an active political campaign (even within 90 days of an election) is serious enough then the Justice Department will be empowered to do their job.

If they were to have uncovered potential acts of treason, which is a capitol offence (and this isn't beyond the realms of possibility given what was uncovered in the raid on Mar a Lago) I would fully expect them to continue their investigations wherever that took them.
