FIFA guidelines aimed at avoiding the “re-refereeing” of matches generally prevent The FA from taking disciplinary action on incidents which are seen and dealt with at the time by the match officials (this includes taking no action). As a general rule, if the match officials see an incident and have jurisdiction to take action, The FA cannot act retrospectively. The referee saw the incident and as such no action can be taken.

Over the summer break The FA proposed changes to the rules regarding taking retrospective action relating to on/off-field disciplinary matters, but the football stakeholders, including The Premier League and Football League, resolved to continue with the present application.

Therefore The FA will continue to apply our rules in such a way that avoids the re-refereeing of incidents that have been deemed to have been seen and dealt with by the referee.

So Gareth Barry or Webb is a liar as according to reports in the media Webb told Barry he didnt see it clearly

Exactly. And Barry doesn't strike me as being a liar.

Fact is, if Webb had clearly seen the incident then Whelan would've got his marching orders.
 
last season Mario (yes, him again) was a few metres away from the ref who was looking at the incident when he accidentally caught that spurs chap. He was retrospectively hung, drawn, quartered and banned for a decade.

a couple of seasons ago adebayor was put on the ducking stool and burned in the wicker man after the event for accidentally catching van persie, after replays and the ref who was there and following play "didn't see the incident"

this season whelan was a few metres away from the ref who was looking at the incident, saw it and dealt with it at the time? If he really did see it his decision was shocking to say the least...will he get struck off this weekend for incompetence?

at least they had the decency to admit that vince should not have been sent off after review, in this case how can he possiby say that se saw it and dealt with it at the time?...

Is it corruption or incompetence? I can't work it out. I don't like to think that the referees or FA or whoever are bent but I refuse to believe that the ref thought that was a good tackle. Or is it just a case of him not being man enough to admit he made a mistake. I'm really not sure but things like this seem to happen too often for it to be a genuine mistake, every time.
