Completely. It makes it even easier for refs and FIFA to influence who wins the games. There is zero conssisteny which just gives it no credibility at all.
 
Its not clear though is it when the majority of people think it wasn't a pen.
They don't know the rules of the game then, it doesn't require intent, just the hand being in an unnatural position. If the referee had judged there was intent it's a straight red card.

Its all very subjective, and that is the issue.

A header going wide, hits the arm of a player, who appears to not be looking. We've all seen them given, and we've all seen them not given.

It doesn't matter if it was going wide, or if he was looking, his hand was level with his head and in an unnatural position and it's blocked the ball.
