ZZPS Parking Fine

These vultures have given me a £100.00 parking fine at 1am saturday morning.
Circle Court Stretford.
I was visiting a friend who had just had a family bereavement and stayed over for the weekend to console him and discuss his financial situation.
He brought the visitor car park pass down and i placed it on my dashboard.
The next morning it was on the seat (fell due to me closing the door i’m guessing)
I didn’t think anything of it as no ticket (phew, that was lucky)
Parking fine came through the post.

I appealed it enclosing a pic of the visitor pass on my dashboard showing my numberplate & my friend also wrote a letter explaining that i was staying at the property and that i did borrow the car park pass.
This has been rejected and now demand £100.00 (do not get me started on how they can charge this)

Any advice would be great from anyone who has been in the same position!

Looks as though i’m £100 down - pep’s gonna have a pop at me now i can’t afford to go the next couple of home games :-(
 
I used the "fell off the dashboard" routine when i forgot to put the blue badge on at MRI and they cancelled the fine and they use a private company. My gut is if it went to court you would get it cancelled.

If you truly was parked there legally i'd take it all the way, what have you got to lose?

Nope, this is being truthful.

Have cut and pasted the comment below from an article in the Times from Nov 2020 (its behind a pay wall) I take no credit for it, they're not my words, but it is solid advice.

If you ever get a ‘fine’ from one of these bottom-feeding private parking companies, follow these steps:

1. Don’t correspond.
2. Ignore all their threatening letters and debt collection agents demanding money.
3. Wait until you receive a ‘Letter Before Claim" [or similar] and if they actually send one
4. Prepare and send a full defence of your reasons for not paying and offer £20 in full and final settlement.
5. Wait.
6. If they do proceed with a Small Claims court action, file the necessary papers with the court with your full defence. But... Point 6 is highly unlikely to occur. Their business model relies on people being intimidated into paying the fine. The only way they can force you to pay is if a judge has heard the case and found in their favour. To bring a case, these firms have to pay £120 and the award if they do win, will not often exceed this amount. Plus they’ll have to engage solicitors and incur further costs, which can’t be recovered under the Small Claims scheme. So a court case is never in their interests. Hold your ground and wait. 9/10 times they’ll take a reduced payment to avoid court and more often than not, they’ll never bring a case - or as described in the article, the cases are summarily dismissed and thrown out. Their evidence is always weak. Their signage isn’t fit for purpose and they don’t want anything scrutinised by the court (contracts with landowners, etc). If everyone who received a ticket from a private parking company did this, they’d all be bankrupt within a month. Their business model is fundamentally flawed, and they know this. Paying £120 to chase fines worth in average £100 makes zero sense. Don’t be intimidated. Don’t back down. Also, the time it’s taking to bring Small Claims cases to court these days is 12-18mths! So relax and ignore anything unless it comes from HMCS.

Are they operating on behalf of a council?

If not continue to contest - not worth them taking you to court for £100............

So who the fuck are ZZPS?

They are a debt collection agency. Odd they are the first to be in touch

If they are acting on behalf of the council (and pending how much you want to avoid paying it), write to your local MP laying it on very thick how this is crippling I'm this current Covid climate etc etc - easy win for the politician to secure a vote I would say........ ;-)
