Is there a legal reason they're using THE Super League and not EUROPEAN Super League?

More money in playing games outside of Europe in the middle east/America/Asia which will almost certainly happen. They won't want to limit the scope of their greed with a restrictive title.

My understanding is that the 5 invitees are based on merit (what a crazy idea) from the previous season - I.e. the highest placed non-founding member from one of each “top 5” leagues or something?

You may well be right.
The issue with the 5 invitees is if they have to leave new league they may not be left back into their previous league
e.g. West Ham qualify from UK.
Can't see them being left into premier league.
