Kicking someone in the head while they are on the ground is a pretty deliberate way of causing someone massive damage, it's not like punching someone who just happens to fall and hit their head. You kick a barely conscious person in the head, they are in big trouble, you do it repeatedly, you should be fully aware of what the likely outcome will be.Stabbing and shooting is more clear cut at you are using deadly weapons.
