Pretty much is. The FIA has stated that it's the Race Controllers descretion that in the end supercedes the rules. That's also in the rules. Basically if the RC believes something needs doing in the best interest of the sport, they can make an off the cuff decision within the rules.

What really? Oh well! Better learn the F1 shrug boys and girls. This is what you get from F1...
