The achilles heel with running a private prosecution is that the CPS can take over the prosecution at any time and have the power to subsequently drop it; although I highly doubt that would occur in this instance. Justice needs to be seen to be done. The right to bring and maintain a private prosecution is enshrined in statute (s6 Prosecution of Offenders Act 1985) and they would not want to be seen to be so publicly undermining that.
One big advantage of conducting a private prosecution is that you don’t expose yourself to any risk of a costs award against you should the prosecution fail, as the defendant’s costs (or a proportion of them) are paid out of central funds, rather than from the prosecution, unless the prosecutor has behaved egregiously. Even if Johnson is acquitted, he will still have to stump up for most of his legal fees (which won’t be cheap) out of his own pocket. Pretty sure he doesn’t qualify for legal aid.
It has all the makings of the trial of the century (so far)
