Benjamin Mendy - City lose case and Mendy awarded £11m in back pay (p168)

He was still under contract to City until 30 June this year (we know this because that’s when he went to the Released List). So that means we never considered him in breach of contract/terminated the contract earlier.

If that’s the case, now he has been found not guilty, it’s hard to see how we don’t owe him wages for at least the period when he was available to train and play (remand feels more difficult for him). Can’t really see the counter argument here unless we had a specific contractual clause dealing with arrest, charge and being found not guilty.

Suspect it will be settled without litigation.
Your last sentence (which I agree with) is probably going to upset a lot of journalists. So that's a silver lining.

Mendy broke bail conditions meaning that he was then denied bail thus rendering himself unavailable for selection through his own actions. So wouldn't be due compensation from that point onwards.

There is probably scope on both sides for a p & c compromise if goodwill exists.

Senior City employees spoke favourably of BM in his defence.

City bought a player for £55million, paid him millions in wages & bonuses, and were unable to recover any compensation when he was in prison/remand or a fee (damaged goods) following his trial/not guilty verdict.

He was back in football at a reasonable, regional level,in his home country in 5 days.

Interesting to learn the outcome in due course !!

It’s likely that projectriver is more learned that yourself on such things.
