If it isn't how we roll nowadays then surely it's not how the Silva deal was paid. So why would there be a problem with Mendy and not Silva pal?

Why would we do that?? Nobody pays all the fee upfront unless it's a relatively small amount.

I thought it allowed us to negotiate a slightly lower fee. I was also under the impression all fees between premier league clubs had to be paid in 12 months in any case.
