Unfortunately its cost Ant big time and please note that he hasn`t been in trouble before as a 49 year old married guy with two children who are in their mid twenties.He snapped alright but how far are you able to control your emotions after several years of shit ?
As others on this forum have suggested,if no-one actually saw what happened,why didn`t he say he knew nothing.Because thats not Anthonys nature and irrespective of what others may say,the one thing he is not is a liar.

Certainly laudable to not be a liar, but as a convicted criminal, with a record for ABH, it is a hollow victory.

Sounds like your mate is a decent fella 99.99999% of the time. Maybe, if he had a few years worth of legal papers, police reports, council complaints and meeting minutes, etc, etc... It would have been the neighbor who came across as the tosser he sounds. Alas, your mate took it and took it and took it until he couldn't take it anymore. THAT was his big mistake. The LEGAL SYSTEM is there to protect men like your mate, but he has to USE IT. In this instance, the scrote used it AGAINST HIM, and left him with little legal recourse than to accept the Judge's demands.

I hope he can get his life back together in 14 months, and hope he can get a different house sorted and get some early release. As a 50 yr old fella without a blemish on my own record, I sound a bit like your mate. Had the red mist a time or two myself, but what you do under those circumstances can make or break you. Thankfully, no-one has gone after the missus in a bar at the time.

Like I said, sometimes you just have to walk away and be the bigger person, even if it looks like you are a pussy. Bad situation all around, but sometimes there is not a good option, just one that is less bad than others.
 
Why would you allow your neighbour to put you through years of grief and torment if you are then going to banjo him in the shithouse (no not like that) for a very slight offending action?

That doesnt add up for me TBH.

Interestingly if the grief and torment had been reported and diarised then the same judicial system that has been 'harsh' in this case may well have been 'harsh' towards the anti-social behaviour of the neighbour.

I haven't managed to read all replies so I apologise if this has already been pointed out.

He would presumably have been charged by the police with Common Assault and gone before magistrates, where I'm guessing he pleaded guilty to that charge. Magistrates then decide whether they can deal with the case or whether it needs to go to Crown Court for sentencing. I guess it was the latter, which would indicate that they felt a custodial sentence of greater than 6 months was appropriate.

But sometime after that, CPS changed the charge to ABH, which they can do. But surely they can't just treat a guilty plea to one charge as a guilty plea to a different one. Therefore he must have been given a chance to plead to the ABH charge? So if he was saying he would not admit to that, then I'm struggling to see how it was in his interest to plead guilty. I know you probably can't answer that, it's just that I can't get my head round why he wasn't advised to go to trial.

It would have had to have been upgraded to ABH before the magistrates accepted his guilty plea to common assault. That's not unusual. A case might be initially charged as common assault, bail granted pending a further hearing. The CPS review the case, decide the injuries are perhaps more serious than first thought and that there are aggravating factors such as use of a bottle so decide to upgrade to ABH. The case goes back to the Magistrates Court and they decide if it should be sent to Crown Court. If he formally pleaded guilty then it was to ABH, not common assault.

Okay Oakie, you've got the guy who followed the other into the bogs saying 'yes I twatted him but I didn't use a bottle', and you've got the guy who got twitted saying 'oh yes you did use a bottle' and you have the landlord who says 'I swept up broken glass from the bogs.'

It seems common ground that if he did use a bottle, the sentence should be stiffer than if he didn't.

Given that under our system of law a judge decides on the sentence (not a jury) what alternative do you suggest to a judge hearing the case to decide whether he did or didn't?

Anyone, IMO, who has it in them to say "enough is enough" and follow someone into a toilet and then best him up, deserves to be in prison. Bottle or no bottle, I'd want this fella behind bars for a long time. Dangerous man clearly.

was this to trick gullible people?just tried the 911 pizza/lady boy hotline and its still an emergency number. Really unimpressed operator when i said i read on the internet it was for other things here. maybe because i called from my mobile.
 
As soon as he heard he was being charged he should have brought a counter charge, also lied through his back teeth about this guy, being honest in this situation can get you put in prison,??? the judge the police the system DOES NOT CARE if your friend is innocent or not, a collar is a collar, karma will come back on this guy, your friend will get time off where ever he lives if he is a model prisoner, the red mist is one hell of disastrous emotion I should know, if you are a true friend support him because his head will be in turmoil.
 
Can't believe the guy did it with people around and then also admitted it.......that's what dark nights , alibi's and balaclavas are for ffs
