What is the difference between a magistrate and a lawyer?

A lawyer (Hamericun term) solicitor as we call them represent the prosecution or defendant and put their side of the story to the magistrate. He/she then decides the punishment, ooops if of course the baddy is found guilty that is, as this person is a scouser it would obviously depends which court he appeared in. Any court outseide Liverpool - guilty any court inside not guilty.
 
Yeah, it wasn't my smartest question. Magistrate isn't a word used much over here (I don't think).
I suppose it's what we call a judge. So I guess the big difference is that a magistrate isn't going to make my wife work on Christmas eve and then the Thurs and Friday after.
Whereas a lawyer (or, a greed of lawyers) is.
