I really think we could have got him on this. Just posing the allegation as a question doesn't get him off the hook. It was a defamatory comment and if we sued Harris he would have to prove it was true (the burden of proof falls to him in a Civil Action). He made the allegation at a public press conference seen by millions of people which would have impacted on the size of damages. However, and this is a bit ironic, I think we are out of time because in the UK you need to launch such a defamation action within 12 months.
