Complaint to the FA Premier League re the Berbatov saga

Another e-mail from Cathy Long:

'I’ll email you Friday if not before. I’ve chased them on it so we’ll wait to hear'!


Sounds a bit more promising, at least in terms of getting them to commit to something on paper that can then be challenged.
 
The exchange of e-mails continues, albeit with nothing substantive to report just yet. Cathy Long wrote:

'Late in the day (20:38), but it’s still Friday! I still need to speak to a couple of people on this, but I do hope to have something for you next week'.

I replied:

'Although it's disappointing not to have a full response thank you at least for coming back to me to keep me informed.

I look forward to hearing from you again in the near future'.


On the plus side, I have drafted my next letter to the Premier League which is a bit of a monster read; it will have to be tweaked depending on what exactly the Premier League come back to me with in the meantime but that said, the work from my side is now largely done.

Yeah , rules probably were broken ..... it's nothin' new where the rags are concerned , neither is the fact that , once again , little appears to be said about it ........ it's like a copper accused of a crime , how many actually get prosecuted , whereas a member of the public would?

Those in power have a discreet way of coverin' things up so that the matter just 'blends' into the background quietly ....... it's probably not the first time that a Fergie transfer deal has been in question , an' it won't be the last either ...... but really , as the player himself had absolutely no intention of signin' for anyone but the rags , what point would there have been in kickin' up a fuss ?

If Berbatov had of wanted to come to City , Fergie wouldn't have got a look-in , no matter how much he had of offered ...... we just have to move on now.
 
Wow Monty, I take my hat off to your tenacity. If you succeed in ruffling a few feathers with all this, then that'll be great.

It's not really relevant to what you are pursuing, but I am SO glad we didn't pay all that money for the lazy sod after all!

It appears to me to be rank spinelessness on the part of the FA, they're empowered to act but a bit of cajoling from enough of their domestic customers might give them the backbone to actually do something. They may have half an eye on the income stream from the millions of plastic rags internationally, but Salford Redsox do not have a monopoly on support (thank God). The right thinking world would, and should, support the application of fair and reasonable rules, if we can explain the arguement to them in a way that media does not appear to have yet been able.
 
I have now received a response from Cathy Long at the FA Premier League:

'I have spoken to the Board members now and am able to provide some clarification on the original message provided by our press team. You are correct when you state that the Board does have the power to act. However it is Board policy not to act in relation to such matters as illegal approaches unless the Club concerned is prepared to make a formal complaint. Practically, it would be difficult for us to get co-operation and evidence from a Club which does not wish to pursue such a complaint. We have to look at each case on its merits and to assess whether we think that there will be sufficient evidence made available to us. Premier League Rules are essentially an agreement between member Clubs that the Board applies, and in the absence of a complaint this is not a Rule that the collective body of Clubs wish to apply. We appreciate your concern but feel that we have followed the correct course of action in this particular instance.

I hope this helps to shed some more light on the issue'.

So despite what they originally implied and as we suspected, they do have the power to investigate, but have decided as a matter of policy not to.

I will post my response on here tomorrow.
 
So essentially what they're saying is because Spurs have been bought off they aren't going to cooperate with any investigation and, no doubt, will actively attempt to prevent such an investigation from finding the truth.

In such a situation I can see why the Premier League don't want to waste their time over it. However, should such an investigation be undertaken and should Spurs prove to be obstructive, then they should be fined heavily for their actions.

Good point, they have actually both broken the rules then?
