European Super League | ECJ rule that UEFA and FIFA acted unlawfully in blocking Super League (p 29)

I would be very sceptical about any cross border league or Super League.
Whilst there are many variables between two sports take a look at the abortion that is the United Rugby Championship.
This is a league made up of Irish, Scottish,Welsh, Italian and South African clubs.
No relegation and apart from your local derbies you play each other once.
Poor attendances in South Africa and Wales and getting even worse.
South African teams in the European Cup Competitions.
It is governed by the broadcasters.
An absolute shambles compared to the English and French leagues.
I’m not sure what I’m trying to say here !!!

That is what people need to realise, FIFA ultimately organise ALL Association Football, from the Jules Rimet final to the Under 10's game in the park tomorrow morning.
By joining a super league out with the FIFA umbrella you are leaving association football, not just the first, but the club, at all levels.

Not just those competing in the new league, but any and all involved in the club playing outside the FIFA umbrella (play for the Under 17's in an expelled club, expect to be banned from playing for your school etc)
This isn't the case, is it? The ruling quite clearly reaffirms the primacy of competition law and that UEFA and FIFA do not have the right to prevent clubs from competing in other competitions. UEFA and FIFA do not enjoy a monopoly of football provision.

I think you're saying that it's a load of bollocks.

Dont be fooled by the istree clubs pulling out. They will use this to secure their future in the champs league
But this ruling has opened Pandora's box. The proposed super league was warned that acceptance of any new tournament would depend ultimately on it satisfying the courts that it met the demands of competition law. This, however, cuts both ways - any attempt to appease the 'istree clubs by securing their future in the champs league would be vulnerable to court action under competition law.

They can play in rival competitions, but not both.
At the time of the first threatened breakaway, there were no rules in place to stop it.
Now there are.
And it is The Club that will be expelled, not just the first team.

Early days but I thought this ruling could be good because it stimies the pl from relegating us in a put up hearing.
City can say our position is we would like to stay with you PL, however if you threaten us with relegation we will have no choice than to speak to the ESL.
So that threat goes out of the window for the PL.

That isn't the case either. The point you are missing is that the law is superior to rules made by any governing body in sport. UEFA/FIFA were not wrong to punish clubs because they had not made rules to ban breakaways but because they do not enjoy a monopoly. UEFA, FIFA and any other governing body are not sovereign bodies and their rules are always subject to review by the courts. Furthermore the new competition clearly envisages clubs playing in both the domestic league and the new super league. I doubt their will be much enthusiasm among clubs or fans for any new tournament but FIFA and UEFA had better wake up very quickly to the realisation that they are regulatory bodies with limited powers and not sovereign bodies with powers to do as they please. They organise the game, they do not dictate to its practitioners or its fans.

The ESL has to abide by the law just as much as UEFA. UEFA fell foul of competition law. So if City were expelled from the PL would the ESL not fall foul of competition law if they offered us a place in the ESL?
