And for that we will fine him a substantial amount.

But not until there has been another disciplinary hearing.

"Trust an expert"? Anyone who owns Employment Law for Dummies must know that the basics of a contract are you turn up and work, we pay you. Whether it's McDonalds or Macys, it still applies. Of course we're not paying the ugly twat.

look at Milans dealing with Liverpool for Aquallani, they will not pay anywhere near you guys expect for Tevez. They will pay the 4 million to get him on loan and say we will pay whatever you want if he does well. When the loan is finish, they will play a waiting game and keep asking for more loans. Tevez mis a great player, but he has really made himself impossible for any big club to spend big money on him as his behaviour will have scared everyone away. As a loan deal, he's perfect

not that I want into get a debate on this - but I do know something about contract and employment law...... and I would suggest that we are probably paying him unless we specifically included clauses in his contract that would address this unusual situation - which I would seriously doubt

The risk here - for either party - would be to do something that could be seen in court to be a breach of contract - CITY will not make that mistake - Tevez 'was' also acting in that manner when he returned to the UK and was 'getting on with it - he just lost the plot.

The PFA were a great help to Tevez in their ruling that basically wiped the slate clean for him - if he could just 'go through the motions' until January.

What will happen (IMO) is:

1/ We will continue to pay, until
2/ We think that the timing is right to hit him with a disciplinary and seek a massive fine - probably with the PFA on our seide this time and
3/ Look for the disciplinary to substantiate a breach of contract - again PFA support (being the legally route for action by both parties) will be important
4/ sell at a reduced fee
5/ sue him for loss (difference between £40 and the actual fee) based on the breach

If we do anything that leaves us open to a breach of contract then he can successfully sue us

I really really hope this is true.

But i just don't see any club willing to pay £40m+ in January. Mr Tevez has been sat getting fat in Argentina for 3 weeks ( just look at how much weight he put on in the 2 week holiday he had before pre season) so if he started training today he would not be fully match fit until Early febuary at the earliest. If he starts training January then your talking fully fit around March/April.

Can't see any club paying approx £40m to have a player fit for 2/3 months max in the season. If he moves in january it will be a loan i reckon :(

I would guess this outcome is more likely. Do Milan have the money, er no probably not let's be honest. Clubs on the continent will stagger the payments too if (in the unlikely event) this goes through. So, 4m now, 4m later, whatever. I suggest Mancini has a word with some of this mafia friends and puts the horses head in Tevez's bed. The guy is a leech.
