Moyes still expects Lescott to stay.... is this guy insane?

The solution is staring him in the face, it's time to cash in on a player who doesn't want to play for the club anymore. To think this will go away after the transfer window has closed would just be daft, Lescott wants out, it's time to pick your phone up david and make it happen!

Im a corporate lawyer, and you know what, in the real world you dont just do whatever you please. if you have a contract you honour it unless a provision can be made with your contract.

but an unhappy footballer forced to honour a contract affects the club a lot more than an unhappy employee would at any other company.

are you new to football..........wake up aussie....your talking out of your arse....THIS IS PREMIERSHIP FOOTBALL......players who are not happy at a club will just turn up and gor through the motions...now which bit of that is breach of contract......to play football at the top level you need to be fully focused and 100%....so how the fuck are you going to argue he's in breach of contract if he's only giving 60%..........dont know how you passed the "bar" in Aus as over here you need to to uni and then law school although common sense cannot be taught.
 
There's no way Kenwright will allow Moyes to stick £18M on the bench. Moyes is quickly becoming an embarrassment to Everton, over his mishandling of the whole affair.
He's allowed his over inflated ego to get the better of common sense.
The sooner this whole sorry saga ends the better for all concerned.

your right, and i agree, my original point and only point was just why people talk about Moyes as if his the antagonist. He doesnt need to defend himself in not selling an important employee.

you can break any contract of employment, can't you? the law will not force you to work, will not grant any injunction to prevent you taking a position at a different organisation. what will happen is that you will be sued. that's why we have transfer fees, i thought, to preclude any legal dispute over the breaking of the contract. the FA will further penalise any club who signs a player who unilaterally broke a valid contract, but the principle remains that the law does not support 'forced labour'.
