In the current environment it’s hard to see an employment tribunal finding Mendy’s actions (as alleged) as anything other than gross misconduct. Certainly all significant judicial determinations since March would support that view. I guess Mendy could point to the club’s apparent inaction in relation to Walker, but I’m sure sufficient distinction could be drawn, especially by a tribunal applying as much intellectual dishonesty as it feels it needs to get to the desired outcome. I can say with some certainty that Mendy won’t be given any benefit of the doubt, should it come to that.
