PL charge City for alleged breaches of financial rules

the difference between how Everton who with out a doubt cheated and us are talked about is staggering. When Everton scored the second goal against Newcastle it was such a tail (fairytale) how the are saving them selfe from the harsh penalty but every City titles are tainted, even it is not proven we are guilty.
Not having a go in any way but this shows how in my opinion wording is used to reflect something that isn't 100 accurate.

Everton did not cheat, and certainly not beyond any doubt.

They put themselves in a position where they fully expected to comply with the rules. Poor performances on the pitch and sanctions relating to Russia conspired and the end result was they missed out by over £20 million. They continued to invest in the team in the expectation that their league positions would improve. I believe if they had finished 3 places higher each of the 3 years over the monitoring period they would have complied. And this is where I see things having the potential to go really shitty, what if they could find evidence of incorrect refereeing decision or VAR errors that went against them which in turn caused them to finish lower down the league again affecting their profiatability?

if you don't like the word cheat its no problem lets just say broke the FFP rules.
City have been called cheats since 2014 , I am saying that the media is calling Everton a fairytale for braking the rules but City a cheats for something which is very hard to proof what happens if City are found not guilty how will the media respond
 
Exactly, if the process isn't independent then it doesn't have any standing because how can it be deemed fair? The Premier League is a football organisation, it isn't an independent auditor or anything else.

A really interesting point is the Premier League is owned 21 ways where each year every league club is given a share and the FA holds the final share (or maybe it's just the 20 clubs, not sure). There is therefore a massive conflict of interest in that actually city have a stake in the very organisation that we're being investigated by, we can even vote against punishing ourselves.

The Premier League gets around this conflict by having a three person independent panel conduct breach investigations but who is this panel appointed by and what expertise do they hold? Nobody knows. They also can only consider any evidence put in front of them which might not be so damning but again nobody actually knows.

At the moment we have to accept this process for what it is however the big challenge will come afterwards if the end result is bad. Everything then comes down to litigation and legal process which I can see being dragged out for 10+ years. The other clubs will have to pay millions in costs to defend against that.

With this in mind and given the unlimited resources that city have, personally if I was the Premier League and city offered to settle the matter quietly and privately then I'd settle!

These include the power to issue fines of up to £100,000, the power to agree sanctions and, where appropriate, to refer the breach to a commission. In 2019, the League moved to an entirely independent Judicial Panel, appointed by an independent Chair (Murray Rosen KC). It is from this Judicial Panel that the Chair selects individuals with relevant experience and expertise to sit on commissions. Where a commission is appointed, it has extremely wide sanctioning powers, including the power to impose significant fines and sporting sanctions.
 
The way I see it is this - City didn’t trust handing over sensitive information to UEFA as the club felt that it could fall into the hands of our competitors, but we trusted handing it over to CAS.
The issue with handing information to UEFA is that the investigative panel led by Yves Leterme was leaking from a confidential investigation CAS went to CAS to get the investigation ruled void due to leaks CAS couldn't rule as there was already the appeal against the ban CAS noted the non cooperation and reduced UEFA's fine from e30M to e10M
 
I've said many times the it will all be hard for the PL to prove. But audits are not a forensic look for fraud. If auditors are mislead or not shown material documents/information then they will have a legal shield to some extent (subject to showing sufficient professional scepticism). So knowingly signing off fraudulent accounts? No but it is a little more nuanced than that.
So then the real question is why would they suddenly think someone had been misleading or not showing them the correct info? Who has forced the Premier League into this?

So true. It’s all beginning to grind me down now. I’m not the sort person who enjoys or thrives on being hated. The fact that city are so hated is making me think what’s the point. Success is something to be celebrated but we’re basically never going to get any credit for the wonderful things we’ve done for the community and changed how football can be played. The hate in this country in general and how it is shown to City is frightening. I’ll just be happy when it’s all over, even if it means us in div 2.
