PL charge City for alleged breaches of financial rules

It expressly says "Subject to the provisions of sections 67 to 71 of the Act, the award shall be final and binding on the parties and there shall be no right of appeal. There shall be no right of appeal on a point of law under section 69 of the Act." So that leaves s67,68,70 and 71 of the Arbitration Act as routes to appeal to the courts.

68 is serious irregularity https://www.legislation.gov.uk/ukpga/1996/23/section/68
70/71 are supplementary (basically process) provisions relating to 67 and 68

So, the ONLY realistic route to end up in the Courts is serious irregularity. It is almost definitely not ending up in the courts.

Serious irregularity means an irregularity of one or more of the following kinds which the court considers has caused or will cause substantial injustice to the applicant—

(a)failure by the tribunal to comply with section 33 (general duty of tribunal);

(b)the tribunal exceeding its powers (otherwise than by exceeding its substantive jurisdiction: see section 67);

(c)failure by the tribunal to conduct the proceedings in accordance with the procedure agreed by the parties;

(d)failure by the tribunal to deal with all the issues that were put to it;

(e)any arbitral or other institution or person vested by the parties with powers in relation to the proceedings or the award exceeding its powers;

(f)uncertainty or ambiguity as to the effect of the award;

(g)the award being obtained by fraud or the award or the way in which it was procured being contrary to public policy;

(h)failure to comply with the requirements as to the form of the award; or

(i)any irregularity in the conduct of the proceedings or in the award which is admitted by the tribunal or by any arbitral or other institution or person vested by the parties with powers in relation to the proceedings or the award.
Doesn’t seem like this would be covered by this but it seems that the only reason sponsors would collude in the way implied by these charges is if they are related parties but they are not according to accounting practice surely this is an issue for the courts to deal with as it’s where the law and FFP / agenda collide ? Perhaps it is procedural I don’t see that they have down an alternate related party definition. But it seems more fundamental than that and more sinister I mean look at how rival fans and journalists see it they think company x is from UAE it’s related they don’t do that with white owners.
 
Save to the extent that the Panel members may have their own biases, I think you should assume quality arbitrators are objective and will deal with it fairly. But even in the Courts, litigation risk is always high. Few cases have merits confidently over 70%
This is why I can’t understand the clubs position on this with their non compliance

they must think they have a rock solid case to beats those odds otherwise why take the risk that you lose and the world caves in

surely they could have settled this with a fine and a slap on the wrist to not do it again ?

they literally don’t want to admit any wrongdoing , a lot of peoples reputations are staked on this

what the hell will the club look like coming out the other side if we lose ! Scary thought

The comments on that article shows how much damage the press and alike have done to our club ( blind hatred ).
If we get through this and I believe we will we should take the fuckers to the cleaners no matter what the cost.

It's a bit of an apple and orange situation but take a look at Real Madrid and how they have always been proactive with issues regarding the image of the club and their players. Just recently, Vinicius was racially insulted again and RM went to court to ask for punishments for the club and their fans and to also ask for more protection for Vinicius. They weren't trying to single out the good batch from the bad batch as we tend to when the barbaric dippers assault us for the 9999.99th time, rather they wanted a punishment that would teach every and anyone associated with Mallorca a lesson.

We need to understand that sometimes being quite doesn't necessarily translate to being the bigger man or taking the high road, sometimes silence could give the wrong impression and most of those clueless dumbfucks commenting on that article are either interested in seeing their club reap where they haven't sown by picking up our trophies and players, while the other half are just sheeps that have been easily manipulated by the media.

Either way, we need to start being proactive. As it stands now we aren't even reactive just fucking docile. How long are we going to walk on eggshells? Shit like this comes up and instead of putting up a defiant strong image, we fall back while some bullshit clause about "Pep walking away if the club has been dishonest" is being talked about.

Unless Pannick can highlight that we’re not being treated fair and impartially.

Having a season ticket holder of one of the clubs that has without doubt pushed the PL to investigate us and which will hugely benefit from any punishment handed down by said Arsenal fanatic would NOT be fair nor impartial. Therefore, not what’s been promised by the PL = irregularity.

I don’t think someone’s football preferences will come into it. If you’ve carved out a legal career like that, why would you put your credentials as being impartial and professional at risk for what football team you support?
 
Tbf, this stage is a PL Commission. After that there is an appeals panel and after that arbitration. I expect the ability to appeal and go to arbitration was an attempt to ensure that accused parties could not go to court alleging onerous behaviour.
There isn't a PL appeals process for this though is there? I may have gotten confused trying to catch up this morning mind.
