PL charge City for alleged breaches of financial rules

There's a fucking lot of flapping going on today....take a breath and chill the fuck out, the punishment may well be a big one for Everton's GUILTY PLEA but them & us are completely separate cases, I'd be more worried if I was still a Chelsea fan than who I support now ;)
Er... they didn't plead guilty. The accumulated losses are a fact but they argued that certain dispensations should be applied (as is the case with PL FFP regs) and that they were within the permitted 105 mill.

Almost zero. We could get a heavy fine or a substantial points deduction which however would be unlikely to relegate us. I would not worry about the raggie tounts.
 
Explaining why Everton's points deduction was so high, the commission said in its written reasons that the cause of the club's issues was because of overspending - largely on new players - along with an inability to sell players, and a lower than projected league finish.

The Premier League had argued for a 12-point sanction for the club.

The club's 16th-place finish in 2021-22 caused a loss of expected income of around £21m, the reasons state.

The commission added: "Everton's understandable desire to improve its on-pitch performance (to replace the non-existent midfield, as Mr Moshiri put it in evidence) led it to take chances with its PSR position.

"Those chances resulted in it exceeding the £105m threshold by £19.5m.

"The position that Everton finds itself in is of its own making. The excess over the threshold is significant. The consequence is that Everton's culpability is great.

"We take into account the fact that Everton's PSR trend over the relevant four years is positive, but cannot ignore the fact that the failure to comply with the PSR regime was the result of Everton irresponsibly taking a chance that things would turn out positively."

The commission ultimately found Everton's failure to comply with the Premier League's "generous threshold" was down to their own "mismanagement".

The chair of the commission, David Phillips KC, also referenced applications for financial compensation from current Premier League clubs Burnley and Nottingham Forest and last season's relegated sides, Leicester City, Leeds United and Southampton.

Phillips said he was "satisfied that the applicant clubs have potential claims for compensation" - but noted the commission holds no "inherent jurisdiction" and it is instead "the role of the Premier League to bring and prosecute complaints".
 
Simon Jordan on talk sport says they have basically been accused of false accounting and 10 points shows this but they accounts have been signed off by auditors so there will be arguments so your just getting into technical details so it shouldn’t be 10

So Simon our accounts got signed off so we are getting into technical issues not fraud as you claim so our punishment should be below 10 points then
 
Yeah ok they didn't but they didn't exactly dispute the charges.
But they did. What they couldn't dispute was the audited accounts for the three seasons in question. They are undisputed facts. What they did argue was that there should be various mitigations due to unforeseen circumstances and that they meant they were below the limit for allowed losses.

That’s not true. They’ve released their figures and breached the amount they can make losses by.

Its not fraudulent accounting, it’s a breach of the rules.

They haven't been accused of false accounting, so that's another falsehood disseminated by the thickest smart man in media.

Failing to cooperate is also something that has to be proved though. Both parties may have different expectations on cooperation.

The Premier League may have asked information that City felt was private and none of their business. Again the burden of proof is with the Premier League on that one too.

30 of the charges are in relation to cooperation. I imagine a breach of cooperation is merely a fine anyway.
City feeling that the requests for info equate to a fishing expedition and thus deciding - no doubt on legal advice - not to comply is likely a sensible business decision, but is irrelevant for the purposes of this tribunal as the PL charter that all clubs sign up to demands full cooperation on any matters the PL may see fit to look at.

As said, it’s most likely to end up being a chunky fine, but in theory all options are on the table, especially for 30x counts.
