You seem to have read 5.4 without, it seems, understanding 6.2

I also have no problem with people posting tweets as long as they're not opinion stated as fact.
I agree that the EU have handled it particularly badly but I find the ill-disguised gloating about it from some on here unpleasant, and the attempts to link it to Brexit pathetic.
Every single thing that’s happened negatively that can be pinned on Brexit has been in here, this thread is EU-UK relations and the EU are threatening Britain.

Where would you want it discussed?

Lukewarm. Both sides will have their lawyers pointing to the bits in the contract that back up their case.

The AZ lawyers will be pointing to the ‘Best Endeavours’ part, EU lawyers will be pointing to Section 13.1 and 5.4, stating no other contract shall impede delivery of this contract and in the event of shortfall (or something like that), plants in the UK shall be utilised.

As always, both sides have a point, but AZ will be painted as over promising and under delivering and the EU will want the vaccines as promised or at least as soon as possible (assuming they ever authorise it for use).

The EU are trying this in the court of European public opinion and there is enough in the contract to make their case, which is why they insisted on publishing the contract, I guess. None of this absolves the EU of their culpability in this affair, though.
 
6.2. Capacity Limitations. In the event AstraZeneca's ability to fulfill its
obligations under this Agreement is impeded by a competing agreement entered into by
or on behalf of the Commission, AstraZeneca shall promptly inform the Commission.
While AstraZeneca shall continue to use Best Reasonable Efforts to engage with its
own contract manufacturers and suppliers to utilize the capacity and/or components, the
Commission will assist in finding a mutually acceptable solution for this Agreement
and the competing agreement. To the extent AstraZeneca’s performance under this
Agreement is impeded by any such competing agreements, AstraZeneca shall not be
deemed in breach of this Agreement as a result of any such delay due to the
aforementioned competing agreement
(s).

5.4 says that for the purposes of acceptable manufacturing sites the UK is deemed as one. It states AZ is freely able to use EU/UK sites to manufacture the vaccine - not that they are entitled to the output.

I can see the EU has some terms it would seek to rely on. Some might be countered as unfair terms or it was “implied it didn’t mean”. This is certainly one for the lawyers, which doesn’t actually help get anyone vaccinated any quicker.
