Political relations between UK-EU

6.2. Capacity Limitations. In the event AstraZeneca's ability to fulfill its
obligations under this Agreement is impeded by a competing agreement entered into by
or on behalf of the Commission, AstraZeneca shall promptly inform the Commission.
While AstraZeneca shall continue to use Best Reasonable Efforts to engage with its
own contract manufacturers and suppliers to utilize the capacity and/or components, the
Commission will assist in finding a mutually acceptable solution for this Agreement
and the competing agreement. To the extent AstraZeneca’s performance under this
Agreement is impeded by any such competing agreements, AstraZeneca shall not be
deemed in breach of this Agreement as a result of any such delay due to the
aforementioned competing agreement

It’s the actual contract though.

I don’t mind if people are tweeting actual documentation like in this regard. It’s vote leave or FBPE accounts posting drivel I object to.

I’m actually struggling to fathom how such a professional and forward thinking outfit have got this so wrong.
Do you mean the EU accepting the 'best endeavours clause' or AZ having production problems?

The EU have asked that. They inspected the factory (for the anti-EU press, a "raid"). If you know why the AZ factories in the EU are producing less vaccine than the UK factories, tell us.
Well I'm not an expert on vaccine production but from what I've read we ordered the vaccine 3 months before the EU, in that time the 2 places producing the vaccine in the UK were able to really get up to speed, tweak things in the production line and increase yields. If the EU had ordered the vaccine at the same time as the UK it's unlikely they would be having these problems. I also believe the vaccine is being made in India for the Indian population, they don't seem to be having problems producing the vaccine.

Well that’s a waste of time.

If you listen carefully you can hear Merkel screaming at Ursula von der Leyen

It gets better

Ursula von Layen said...
“No. There are binding orders and the contract is crystal-clear. AstraZeneca has expressly assured us in this contract that no other obligations will stand in the way of fulfilling the contract.”

The contract states...
“AstraZeneca shall not be deemed in breach of this Agreement as a result of any such delay due to the aforementioned competing agreement(s).”
All irrelevant. Competing agreements between this contract and others entered into by the Commision or independently by EU states (so they could), not with other countries.

My hot take is 5.4 - the EU is entitled to vaccines made in the UK.

The EU basically cocking up their strategy and then claiming that clause didn’t exist, when it blatantly does.

It just reminds be of UEFA with City.

In their defence I genuinely believe they’re better than this, it’s them at their worst.

Think you need to reread that paragraph again to be fair. That and 13.1 is exactly what the EU will argue is the breach.

I also have no problem with people posting tweets as long as they're not opinion stated as fact.
I agree that the EU have handled it particularly badly but I find the ill-disguised gloating about it from some on here unpleasant, and the attempts to link it to Brexit pathetic.

"Britain, spooked by the battle to find plastic gloves and other PPE in the first wave, wrote into its contract with Oxford-AstraZeneca a stipulation that vaccines made in Britain would be offered to Britain first. We signed in May. The EU dithered for an extra three months and didn’t agree terms until the end of August. It failed to extract similar promises on delivery. It will now wish that it had"
