It’s not in my mind that he’s a cheat or incompetent (I doubt he’s the former but he might be the latter) — it’s that he’s a fucking coward. The obvious second yellow on Milner underscores his mindset on the Foden box call. He pissed his pants, simple as.VAR can't step in on that, was outside the box.
I think the refs probably left that to play out and wait for var to review if it's a foul and in the box, it's the easy thing to do. whilst it isn't right it is kind of understandable.
It's one of the parts of the game that make little sense under the current rules. Why can't var be looking at that as play goes on and suggest a card, which can be brandished when play next stops. it doesn't stop the game. Refs are human, they'll naturally play safe when they have var to fall back on, if var hadn't been there he makes that decision straight away gives a foul and a yellow.

He is both a cheat and bad. But how is this any worse than Oliver's non call on TAA? It is systematic corruption and very likely tacitly encouraged by the FA. If you’re too petrified to make the proper calls when they’re obvious, you shouldn’t be officiating at this level when the stakes are so incredibly high. Again, not saying he’s a cheat or even bad — but you can’t ignore fouls because of their possible consequences on the match. That’s what you’re there for.
