It is bizarre that he's said it in such a direct way.

My first thought is that Gullis had flirted with joining Reform, and the personal info is related to that. That would at least make Tice's comments a little more reasonable, even if the language is stupid.

What elements need to be established to prove blackmail?​

To prove blackmail it must be shown the defendant did the following things:

• made a demand;
• with menaces;
• that the demand was unwarranted; and
• that the defendant has a view to make a gain for himself or another or have intent to cause a loss to another.

Section 34 of TA 1968 defines gain and loss as including only gain and loss of money or other property.

Not sure Richard Tice has a view to make a monetary gain from this.

Gutter Newspapers have frequently deployed such tactics and not committed blackmail.

What would a threat of releasing compromising photos fall under, if it weren’t in exchange for money, but to trash an opponent.
