I agree it's a border that doesn't work, however it would be difficult for the Tories to argue that it doesn't work as they keep telling us it can.
All that said I beleive at some point sooner rather than later the UK government will have to concede the only way the border problems with Ireland can be fixed would be for the UK to join the single market. When that happens the Scottish English border issues would be solved too.
