It depends. What happens is the FA look at the referees match report. If an incident takes place during a game which is not included in the report, the FA can then show the footage to the referee and ask him what action he would have taken had he seen it. So it depends on a) whether it was reported by the referee and b) what the referee would be inclined to do.

The post Torres rule change (lucky Jose) means that even if the ref saw them, they can still ban.

This is what they said at the time:

The FRA (Football Regulatory Authority) has now given its approval so that The FA will be able to consider retrospective action in the two following situations, in addition to those already within the existing charging policy:
firstly, for acts of violent conduct that occur secondarily to a challenge for the ball;
and secondly, in off-the-ball incidents where one or more match official did see the players coming together, but the match officials’ view was such that none of them had the opportunity to make a decision on an act of misconduct that took place within that coming together.

This enables The FA to consider acts of violent conduct, like an elbow or a stamp, which have occurred after a challenge for the ball or coming together of players.

The BBC are still pushing this. If you need any further proof that a pro United stance is at work look at the precedent they mention. Precedent was set for retrospective punishment when Januzaj was stamped on this season. I think it was a good few years before that when the precedent was set.

Why a pro united stance surely more likely to be a pro Chelski, Rags or Liverpool?

He will get a ban. Might as well get used to the idea now. It might only have been a tap but that doesn't matter the intent was there and he will get done for it. With Fernan out it was beyond idiotic as it leaves our midfield very weak and Toure is one of the best midfielders in the world he doesn't need to be doing this sort of thing. Hope Pellegrini has him running none stop laps in training for being so air headed.
