There is a key point here - UEFA saying it’s binding doesn’t necessarily make it binding. UEFA think they can make rules that by-pass statute and legal convention... in reality they can’t.
I'm no legal expert, but Castles says that the MOA "commits ECA clubs to 'the explicit exclusion of [using] any State court' to challenge the enforcement of Financial Fair Play regulations". We're not challenging the enforcement of FFP regulations, we're contesting that due process wasn't followed and that evidence was seemingly ignored.
This is the offending document. I think Duncan is referring to clause D.11. Whilst we aren’t challenging the enforcement of FFP regs at the moment, presumably we would want to in future, if CAS rejects both our current appeal and the one that might follow any punishment? So it’s CAS or bust? Seems like we can’t go to anyone other than them? Makes me wonder if UEFA have their claws into them too.
If we feel we are being unjustly punished, why can’t we take it to a proper court of law not just the CAS sports one? Surely we could argue about loss of business, commercial value, income, etc at a real court not just the one for sports arbitration?
