I'm no legal expert, but Castles says that the MOA "commits ECA clubs to 'the explicit exclusion of [using] any State court' to challenge the enforcement of Financial Fair Play regulations". We're not challenging the enforcement of FFP regulations, we're contesting that due process wasn't followed and that evidence was seemingly ignored.

This is the offending document. I think Duncan is referring to clause D.11. Whilst we aren’t challenging the enforcement of FFP regs at the moment, presumably we would want to in future, if CAS rejects both our current appeal and the one that might follow any punishment? Stefan seems to be looking at it on Twitter

Yeah, sorry mate. Think I misinterpreted the article. Ignore me!

You are David Conns dad and I claim my £5.00 prize.
That may be true but social services did not catch up with me.

DC has his own reasons for falling out with owners generally but to only pick on City when there is so much greed and barriers to entry about seems he is being selective with his hatred.

So it’s CAS or bust? Seems like we can’t go to anyone other than them? Makes me wonder if UEFA have their claws into them too.

If we feel we are being unjustly punished, why can’t we take it to a proper court of law not just the CAS sports one? Surely we could argue about loss of business, commercial value, income, etc at a real court not just the one for sports arbitration?

CAS has ruled against them plenty of times previously, but I would much rather place my faith in proper Court appointed judges. I’m fucking weary of the whole crooked set up we’re having to deal with. One of the biggest multi-billion dollar industries on the planet, and there’s no recourse to legal action. It’s bullshit

It cannot be enforceable that Uefa can prohibit taking the matter to a higher court. It may be in their rules, but it won't be a legally enforceable rule, in my opinion. Regardless, we have taken this decision because they have not applied their own rules. In a tribunal type court, that normally makes upholding an investigation ruling extremely difficult.
