So CAS is an arbitration tribunal based in Switzerland. But surely our real beef is with European competition law in that FFP is an anti competitive restriction, put in place to benefit the existing leading clubs? If we wished to prove that, would we not have to have it heard in a British/ European court?

And this is why UEFA are in an awkward position. A challenge to FFP may well win.
If City have agreed to work under FFP, then European law is less important, other than as a big stick to be carrying just in case it's needed.

He did a YouTube discussion with PB and got schooled a bit, insisted there was no agenda against us but came across pretty decent in the end, I think he was won over a bit. At least I think it was him did the interview lol.
 
City have agreed to work under FFP rules. They are also saying that they have not got anything to hide, and the last investigation which resulted in a fine was the end of it.
 
So this looks like UEFA have already backed down on us breaking FFP rules and are instead trying to ban us under the pretence that City mislead them. How can you have one without another?
What this means is UEFA are saying OK you passed but you passed in a different way than we thought so we are banning you.

That absolutely will not fly. UEFA think they are above the law if that's the game.

Isn't this conjecture? The only thing UEFA have said publicly is:

"The CFCB investigatory chamber had opened an investigation into Manchester City FC on 7 March 2019 for potential breaches of Financial Fair Play (FFP) regulations that were made public in various media outlets."

There is absolutely nothing in that statement to say which specific aspects of FFP City are alleged to have breached. Usually when a trial or a regulatory investigation is underway, you get to know the alleged offence; murder, robbery, fraud, money laundering, misstatement of accounts etc etc. In this case we don't know.
Unless someone can enlighten me.
 
I am pleased the club is standing up to challenge them. However, although we are a strong community within the club, players, owners, fanbase etc. we have no natural friends or allies in the wider football community. All the big clubs and institutions, and almost all media organisations, want us to fail and burn.

We are doing things differently from other clubs and challenging their success and income streams. It could be a tough job getting justice.

If we win this initial FFP/CL battle with Uefa, it will likely make them more determined to hit us with other things like transfer bans or maybe making the ownership of multiple clubs against the rules? Or setting up a European super cup without us?
We need to be squeaky clean in all we do because they will look to punish any transgressions.

I have confidence in our fabulous owners, but we are playing in their playground, and they are making the rules.
 
IF(and I'm not suggesting that this is the case or that I believe it is) wouldn't these allegations be cause for criminal action against the club and whoever signed off on the accounts? Furthermore if there is evidence that such has happened wouldn't it be incumbent on the governing body to pass such onto the relevant authorities, none of which seems to have transpired. What the club are being accused of, seems to me not to be some rule breach within the game, but acting illegally and it would seem totally inappropriate for this to be dealt with as a footballing matter
 
Is CAS our only option ?

I think this is bigger than just a sporting issue. Etihad will almost certainly bring a legal case if UEFA try to infer they lied in their accounts. This is getting bigger than UEFA have pockets to fund
 
I dont think this is a racist thing ( Arab thing ) by UEFA. I think this is a power struggle between the new and the old.
Perhaps not, but the smear campaign orchestrated by whoever in the media is most definitely using racism as its' wooden spoon, to stir the pot.
It has very much changed from just FFP which has been largely discredited, to being an Arab Nation State, guilty of all manner of immorality, laundering their reputation through the purity of professional football.

Have I overstated that?

About three weeks ago, Manchester City made a very detailed submission that extended to more than 100 pages.

It has not gone unnoticed by the club that it is five years to the day since Uefa announced City had breached FFP rules and fined them £49m, although City received £33m back three years later after they met regulations.

According to CFCB's own regulations, they cannot bring prosecutions more than five years after the event.

In the referral it is understood the CFCB said that through their submission there are further questions to be asked of City but, since their submission, none of these questions has been put to the club.

This is particularly interesting. UEFA trying to punish City for not abiding by rules/process, yet UEFA are not following due process themselves. Hardly a sound footing. When you also consider, as @tolmie's hairdoo raised, that the timing of the NYT article and notice of referral, it all adds up to UEFA being seen as acting unreasonably and lacking in fairness. It's hard to see an independent judicial committee/organisation siding with a governing body in this instance.

It was definitely him, post match. Not sure who else was involved.
 
The 5 year timeframe to bring prosecution - I wonder if that is formally announce charges, or just pass it to the AC.

Presumably UEFA think the latter.
