You know a law must be a ludicrously obvious racist, fascist, separatist far-right fever dream when the 5th Circuit Court votes 2-1 to say it is likely unconstitutional before arguments even take place.

 
what's so special about the 5th Circuit? Are they nutjobs?
They are (intentionally) the most conservative appeals circuit in the US and are often targeted by far-right political activists to receive appeals related to cases they have brought against the federal government.

It has become so obviously biased toward right and far-right ideology that that wing will intentionally pass controversial legislation within the circuit's jurisdiction (Louisiana, Mississippi, and Texas) knowing lower courts may strike it down, just so it can be appealed to the 5th, where it is much more likely to be passed constitutional, before often further appealed to a super-majority Supreme Court, now with a lower court ruling in favour of the law's constitutionality, giving the Supreme Court a way of avoiding ruling on the matter by simply declining to hear the case. That remands the case back to the 5th Circuit, upholding their ruling, and allowing the law to go in to full effect. They also target specific lower judges in Texas (via a truly ridiculous jurist selection system that is easily manipulated) that are Trump appointees that consistently make farcical judgements, many of which fly completely in the face of established law and precedent.

Add this to the rapidly growing list of examples of the far-right corruption of the Supreme Court. They essentially ran out the clock, forcing the use of the gerrymandered congressional map without having to officially rule on it.

South Carolina to use ‘unconstitutional’ congressional map after Supreme Court silence​

The state will use maps deemed racially gerrymandered in the 2024 election, a lower court ruled, because the Supreme Court has not resolved a case it heard in October.

There is a concerted effort to take jerrymandered states to court to force changes in the maps. Mostly successful but it’s a long haul. SCOTUS recently ruled that individuals could not take a state to court on this question. Why not?
