Well that's to overturn a decision. As far as I can tell, he never even made one. Didn't signal a penalty, didn't signal a corner.
No, VAR can intervene even if the referee does not give a decision. In fact, that was the main reason given for VAR: to pick up infringements the ref couldn’t see.
The ref didn’t immediately give the penalty on Grealish and no doubt they will come out later and say VAR found there was no “clear and obvious error” to require the ref to via the incident.
The threshold allows them to pick and chose when to have VAR intervene.
