Tbf that wasn't his only thought. He did take into account the situation they were attempting to flee from.AND the fact that the judge thought not living in the same country as your brother deprives you of your human rights.
I agree it's a bit flimsy but that was the narrow point on which the appeal was granted.
Surely as a blue you'd be mindful of the intricate nature of legal processes by now ... or are you literally just a KDB fan boy?
