Not sure I agree with this one. It's a lawsuit waiting to happen.
Sooner or later they're going to accidentally knock an innocent rider off their bike and then what?
I doubt they are randomly going round knocking moped riders over, this will be people they are in pursuit of.
When using force officers are governed by the following legislation:
I doubt nugding someone off the road breaks any of these above so a lawsuit is unlikely to be won.
- Section 117 PACE 1984 (when an arrest is made force may be used)
- Human Rights Act 1998 (force must always be proportionate, legal, officers are accountable and it must have been necessary)
- Section 3 Criminal Law Act 1967 (officers may use reasonable force in the circumstances to prevent crime)
- Common Law (an officer may use force to protect themselves or another)
As someone who has been kettled in london and slapped round the head by a copper unreasonably outside the swamp, plus section 60'd unecessaraly I have no great love of the police, but will defend them in this instance
I appreciate this, but surely you know better than anyone, with your previous experience, you know the Police don't always abide by these laws they're "governed" by?
And who decides what's proportionate force is the issue. Guy nicks a phone on a moped, is it proportionate to knock him off that bike at 30mph? Could genuinely kill them
Edit- also I said they could get it wrong and knock an innocent person off. I mean they shot an innocent man to death so it ain't out of the question!
