Aguero banned for three games (updated)

The video evidence isn't conclusive so it's not frivolous

Also means he will be fit for the derby if available otherwise doubt they'd have bothered to contest it

Or he's out for at least 4 games regardless hence nothing to lose. Hopefully your suggestion.

Just showed it again on sky sports although Sergio goes back with his elbow it brushes past reids cheek with no contact for me,but it's the intent which will see him banned not even if he hasn't caught him,but stranger things have happened so let's wait and see..

Delighted we are appealing. I presume the club asked Aguero if he intended to elbow or lash out at Reid and he responded that he didn't...which is what I believe I've seen....i.e. normal on the ball tussling that when slowed down can look wrong. I'd imagine too that Aguero is sickened by Reid's over reaction. (reminds me of RVP's public letter - what a tool!)

I'd prefer to lose and have an extra 1 game ban than to roll over.

I'd not be so principled if we had a final in the next 4 games though. :-)

It doesn't have to be conclusive to be frivolous.
'Conclusive' and 'frivolous' are both at their discretion.

It would be interesting to know the percentage of successful appeals / challenges.

Fuck me can't see how we are going to win this, but there you go,if they reject his appeal will it be four game ban? Anyhow fair play if they think they can win this, the uproar it would cause if aguero did win the appeal especially from rags haha..
And he wasn't fit for the derby !!!

There must be something in the rules that has made us go for it. Given the referees position, maybe our argument would be they might as well bring in video refs if they arent going to go with a refs decision from point blank range.

It wont be a frivolous appeal either, as that would be something along the lines of us only appealing so the ruling would be after the United game, meaning he could play... which wont be the case here.

I thought the extra game was for a frivolous appaeal. But we are contesting the charge, not appealing so don't think the extra game applies.

Can't absolve Sergio of responsibility, it was reckless and could have cost us 2 points at least and, having watched it retrospectively, Mariner may feel as though he misjudged the situation. But Mariner is an experienced, reasonably well paid, full time professional referee and making accurate and fair decisions on real time incidents during a game is one of his prime job requirements and, as such, I cannot believe he did not see that incident. It wasn't off the ball and he had a clear, unobstructed view, the fact that he, the FA, the media and whoever else think he made the wrong call at the time doesn't give the FA the right, under the current rules to reappraise it.

Personally I do not think it warrants a ban but I think being objective I can see why others think differently.

Its a question I have raised on here before Bozzie and I am still not sure of the answer. What is considered 'seeing an incident'. Its pretty obvious Marriner saw the incident but in real time would you be able to see intent by a player or with any certainty that an elbow was thrown rather than pushed outwards to hold a player off?

I do not know but I would guess Marriner presumed there was not much in the elbow, if anything, and it was only retrospectively viewing the incident he concluded that there was intent and the elbow was intentionally thrown in the direction of the player. Whether that scenario would enable a ref to state he did not see the incident I dont know, but I think that is what has happened.

Just taking a look at rag cafe..... oh dear

Corrupt Bertie FA doing their best to help him put his argument forward.

Berties and their FA are shit scared of us, dreading playing us on the 10th and want Aguero to be a part of it. They won't let us win the league easy lads, you can me sure of that. It's going to stink, stink like stunk at the end of last season when Berties were given all decisions in their favour to help them qualify for 4th. Can't have baldy in the Europa, can we?

Their having mini meetings in Stockport reading through the rule books and finding out ways to change the rules so elbows can put in a solid appeal and avoid the ban.

Bertie cnuts.

And which teams the players belong to who have successfully appealed.
