Football Leaks/Der Spiegel articles

I personally hope that if we get a ban and follow it up with an appeal to CAS that any ban is not just overturned on the basis of UEFA failing to follow their own process. I really hope we insist that the facts come out and we show once and for all that we were not in breach of FFP regulations. I just hope the facts are as clear cut and back up the confidence that Khaldoon and the board have in them. If that happens we can start firing back at some of the press detractors and issue legal proceedinga as and when necessary.

They’re stuck between a rock and a hard place, so personally I don’t think proportionality will be uppermost in their minds. Keeping the cartel happy whilst passing the hand grenade to someone else will be all they’re after. I keep coming back to what this is all about, namely money, and specifically a load of greedy Americans who thought they were going to make a killing, but are being (broadly speaking) prevented from doing that by City. Beyond tarnishing our reputation further, I don’t see that a one year ban would achieve what they want. Lots of variables of course. What would the potential blowback be in pushing our owners too far, how much resistance might UEFA show in the face of the cartel’s demands, etc.

You seen how much we made this season in the champs league 82m thats a massive amount of money! City wont sit back and let that happen.

Is would want city to tell them we want a full on apology for the ongoing assault if our club

I agree but it is never going to happen.

If we're in the realms of wishful thinking, I'd love Cityto commission a documentary produced by a real journalist. A financial "All or Nothing" exposing this charade for what it really is. There's loads of material out there. That sinister photo of Woodward, Henry, Gazidis etc having a "business dinner" always springs to mind when we start talking "cartel".

And it would make a fantastic programme, a series in fact, when you start delving into the political views of the likes of Tebas and the corruption at the heart of UEFA with Platini and his ilk.

Some might say that’s why that kind of subtlety is left in all of his posts no matter how many times people pull him up.
Just because it’s the norm in the media. Do you want it to be acceptable here too?
My own opinion is what he said is perfectly reasonable at one level but purposely left ambiguous.

You get a bit sick of playing games.
Particularly with posters who openly claim to be from European royalty.
Which one doesn’t really matter.
That's exactly what I've been thinking regarding the tosspot @gooner6729

The mods will have been keeping a close watch on him no doubt, hopefully he'll be gone soon.

this process will play out as follows:

1. we get a ban for one year from the uefa investigatory chamber.
2. we appeal it and it goes to CAS.
3. we win in CAS because there is no case to be heard or defended.
4. we are not banned.
5. uefa comply with the cartel wankers in banning us, and they can slope off knowing they wont get shit from anyone cos they 'did their bit'
6. city continue to play in europe and our reputation, although just about intact, is forever tarnished.
7. media continue to remind every reader of our 'alleged contraventions' at every opportunity.
8. supporters continue to put asterisks against anything we achieve.

just another day at the office for city!!!

Don't forget that the club statement said the false allegations were harming our commercial operations which means they will go all out for damages.

But who from?

Spiegel got hold of some emails and published them. No-one has denied these are real.
UEFA announced an investigation, which is defensible.

I doubt either would easily be liable for damages.

True. But I think that some of the media that have provided platform for anyone alleging "financial doping" might be susceptible to legal action because "doping" is synonymous with cheating and dishonesty which (so far) has never been alleged as far as I can see.

Possibly, but I doubt it is feasible to make something like that stick.

And then you'd have the previously cited issue of "evil City bully free media".

And you'd have the problem of quantifying damages

If you took the volume of negative articles written about us over the last 10 years online and in print - there would be 100s of thousands. Many of these have been briefed out by UEFA officials and board members and by UEFA members - other clubs or federations. Given the scale of our turnover and sponsorship deals - we could claim 100s of millions in compensation and I wouldn’t put it past is to do that. UEFA and their cronies underestimate what they are dealing with and we may look passive but maybe we are just keeping our powder dry - as Khaldoon said we know who says what. Organisations like Uefa think they are above the law - you can see that in their everyday behaviour but they are not above the law and they have a miserable record in legal proceedings largely because they start off thinking they are above the law. I honestly think our owners in time will change the face of world football and rid us of the cartel and the parasites.

Yup. Agreed. But I think we'll continue to be discrete about it and, at times, we'll be forced to take further "pinches". I really don't see that an out and out legal war will do anyone any good so I can't see it happening.

The media is a different battle and I have no doubt we are building contacts around the world to start a new wave of less hostile media partners.

This
A rag mate of mine ( one that is on our side regarding FFP ) was at a wedding last week and was sat next to a UEFA Member and after drinks this is virtually what the person told him . And to add UEFA as a body hate the FA they find them very ignorant and arrogant

This is a big issue that seems to be missed by a lot of people. If UEFA do what I think they will do and ban us for a year then the next year's balance sheet is missing 82m (probably in excess of 100m when you consider most sponsors have clauses about CL exposure). Where do we find that money to bring us into compliance for the next cycle of FFP? The spending this summer will say a lot about what the club's anticipates happening, if we're worried I expect less activity than usual, maybe 1 or 2 up and coming players on lower wages.

Utd's players all took a huge hit in pay for not qualifying for the CL this year, I'd imagine our players have similar contracts which could get messy as we would have qualified but haven't been allowed in.

It would be very difficult for UEFA to justify a three year ban even if they had concrete evidence of any wrongdoing!

Aye. It would be the equivalent of a £300m fine plus damage to reputation. It's fair to say that the punishment would not be proportionate. Pretty sure CAS would make a judgement on proportionality, as well as procedural fairness.

They can do whatever they want to City because the demon must be slayed.

Innuendo and incessant propaganda goes a long way when it coincides with self-interest and political prejudice.

I agree. And that's why I think they'll give us a 3 season ban. That way, when we appeal to CAS, there's a chance the punishment would be reduced to "only" a one year ban (remember we're talking arbitration) as being more proportionate.

UEFA must know we're going to appeal a ban, what do they have to lose by making an example of us ?

I disagree with a lot here and actually think another pinch would be fine and suit both us and UEFA. This all relates to a year they could not possibly go back to for a third time and since then are house is in order (unless I'm missing something and they are claiming sponsorships are still inflated?). I think we did some accounting tricks, whether it was IP company etc. this sponsorship to get round the rules (which are grossly unfair), but from 2014 onwards we have been fine. We are now the 5th biggest clubs and although you get the empty seats etc. jibe the Puma money shows how far we have come on. We run our business very well as can be seen by transfers and wages. Fans of other clubs may not see it but we do and the football people at other clubs do as well.

The club seem adamant in there position but this could just be a tactic, prepare for war and hope for peace is certainly not a bad approach.

Be interesting to see how this comes out in the wash, the power the established clubs have over UEFA is what makes this uncertain.

UEFA always claimed FFP was about getting clubs to be sustainable without owner investment, City are a sustainable business and if they win the CL in 2020 it is won after 6 years of sustainability.
