Man notified of burglary via app goes home murders burglar [Liverpool]

It might not be. Let's say you swing that golf club and the burglar dies, you'd be up on similar charges, so where do you draw the line? Is the throat slit too far? Absolutely. Is killing someone in self defence of your property? I'd say no. The method, therefore, is secondary to the outcome for me.
I think if you pick up an item in your house to "defend" yourself saying you feared for your life then you would likely not get charged.
If you hear about a burglary and travel back to your house armed with a weapon then you're def in the shit with the law.

Well, I don't think you should be.

You conspicuously misapprehend the legal process.

Who ultimately determines whether the force used by a homeowner in defending their property is reasonable and proportionate? A jury, comprised of homeowners who will be asked to bring their own experience and common sense to the fore to arrive at their verdict. Are there circumstances where twelve members of the public would conclude that killing an intruder was a proportionate response?

Of course there are. Plenty of them.

Juries will always give a homeowner the benefit of the doubt. And quite right too.

I wouldn't attribute common sense to a jury.

Nonetheless, my threshold for reasonable and proportionate is clearly higher in this regard.

He didn't kill him inside the property, he saw him fatally wounded in his garden after his first attack and decided to slit his throat. No rational person would do that they would have phoned the police as the man was no threat to him now.

3 thieves apparently and the man murdered doesn't look like the opportunist smack head type. Looks more like a dealers gaff getting turned over for watches or cash.

Charged with murder? He’s the victim here, it’s not his fault!

I was speaking about this earlier. The issue is that they made out that his wife was in danger. He had called her on route and knew she wasn’t at home and wasn’t in danger. Stabbed the lad in the body and face, through the eye and into the brain. Then left in the car. Crashed the car when he returned. Then stabbed the lad through the neck, cutting his jugular, and killing him. They then tried to hide evidence. Burglars are scum but that is particularly cold. Also, it isn’t clear that the burglars were armed. There is a suggestion the home owner or his brother in law has a gun though. A good battering should have sufficed, before handing them over to the police. To stab the lad multiple times, breaking the knife off in his eye / brain, then leaving and returning to finish him off was OTT. Absolute twat……
